Amnesty International’s new investigation shows that Israel imposes a system of oppression and domination against Palestinians across all areas under its control: in Israel and the OPT, and against Palestinian refugees, in order to benefit Jewish Israelis. This amounts to apartheid as prohibited in international law. Laws, policies and practices which are intended to maintain a cruel system of control over Palestinians, have left them fragmented geographically and politically, frequently impoverished, and in a constant state of fear and insecurity.
The international community has over the years detached the term apartheid from its original South African context, developed a universal legal prohibition against its practice, and recognized it as a crime against humanity with definitions provided in the 1973 International Convention on the Suppression and Punishment of the Crime of Apartheid (“Apartheid Convention”) and the 1998 Rome Statute of the International Criminal Court (ICC).
The Israeli regime enacts in all the territory it controls (Israeli sovereign territory, East Jerusalem, the West Bank, and the Gaza Strip) an apartheid regime. One organizing principle lies at the base of a wide array of Israeli policies: advancing and perpetuating the supremacy of one group – Jews – over another – Palestinians. B’Tselem rejects the perception of Israel as a democracy (inside the Green Line) that simultaneously upholds a temporary military occupation (beyond it). B’Tselem reached the conclusion that the bar for defining the Israeli regime as an apartheid regime has been met after considering the accumulation of policies and laws that Israel devised to entrench its control over Palestinians.
